1) About our products

 

We sell:

 

• Physical photographic prints (including framed print options)

• Digital downloads (where offered)

 

Some products are produced and shipped using an Australian, Melbourne-based manufacturing partner (“our production partner”). We do not store large volumes of finished stock; many items are made to order.

 

2) Copyright & ownership of images

 

All photographs, videos, text, logos, and website content on this site are owned by Scott Robert and are protected by Australian and international copyright laws.

 

You may not:

 

• copy, reproduce, distribute, display, publish, sell, licence, or modify our images/content

• use our images for advertising, branding, print-on-demand, NFTs, AI training, merchandise, or resale

• remove watermarks or metadata

  without prior written permission from us.

 

Purchasing a print or digital download does not transfer copyright—it grants you a limited licence as described below.

 

3) Digital downloads licence (personal use only)

 

If you purchase a digital download, you are granted a non-exclusive, non-transferable licence for personal use only.

 

You may:

 

• display the image on your personal devices

• print for personal display at home (reasonable quantities)

• post on personal social media with credit (e.g., “Photo: Scott Robert”) and without claiming authorship

 

You may not (commercial use prohibited):

 

• use in any business, commercial, or promotional context

• use in paid ads, websites for business, branding, packaging, products, merchandise, or resale

• supply to third parties (including media outlets) without permission

• upload to stock sites or licensing platforms

4) Frames & warranty (10 years)

 

 

Where a framed product is supplied, frames are produced by our Australian production partner and come with a 10-year warranty on the frame (subject to normal use and care).

 

This warranty generally covers manufacturing faults in the frame itself and does not cover:

 

• damage from misuse, accidents, drops, impacts, water, humidity, extreme heat/UV exposure

• normal wear and tear

• damage caused by improper hanging or installation

• changes in appearance caused by environmental conditions over time

 

 

This warranty is provided in addition to your rights under the Australian Consumer Law (ACL).

 

5) Colour, crop, and product variation

 

Because screens display colours differently and prints are produced using professional print processes:

 

• Colours may vary slightly between what you see on screen and the final print.

• Some products may be cropped slightly to fit standard print sizes or frame ratios.

• Minor variations in materials and finishes can occur between batches.

 

These variations are normal and are not considered defects.

 

6) Orders, pricing, and payment

 

All prices are shown in AUD unless stated otherwise. Prices may change without notice.

 

Your order is confirmed once payment is successfully processed and you receive an order confirmation email. We may cancel an order if there is a pricing error, stock/material issue, or suspected fraud—if so, you will be refunded.

 

7) Production times & shipping

 

Many items are made to order. Production and delivery timeframes shown on the website are estimates and can vary due to:

 

• production capacity

• courier delays

• peak seasons

• weather or events outside our control

 

Risk of loss/damage in transit is handled as set out in the Returns/Damaged Goods section below.

 

8) Returns, refunds & change-of-mind

 

Physical prints & framed items

 

Because many products are made to order, we may not be able to offer change-of-mind returns. However, you are always protected under the Australian Consumer Law.

 

If your item arrives damaged or incorrect, see the “Damaged or incorrect items” section.

 

Digital downloads

 

Because digital files are delivered instantly, change-of-mind refunds are generally not available once the file has been delivered, except where required under the ACL (for example, if a file is defective and we can’t fix or replace it).

 

9) Damaged or incorrect items (important)

 

If your order arrives damaged, faulty, or incorrect, please contact us within 7 days of delivery at scottrobertphotography@gmail.com with:

 

• your order number

• photos of the packaging and the damage/issue

• a brief description of the problem

 

We will work with you and our production partner to provide a suitable remedy, which may include replacement, repair, or refund, consistent with the ACL.

 

Do not dispose of the item/packaging until advised, as couriers and insurers may require evidence.

 

10) Care instructions

 

To keep your artwork looking its best:

 

• avoid direct sunlight for long periods (UV can fade prints over time)

• avoid high humidity, heat, and moisture

• clean frames/glazing gently with a soft, dry cloth (avoid harsh chemicals)

 

Improper care may void warranty claims.

 

11) Limitation of liability

 

To the extent permitted by law, we are not liable for indirect or consequential losses, including loss of profit, loss of data, or business interruption.

 

Nothing in these Terms excludes any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law.

 

12) Website use

 

You agree not to:

 

• attempt to hack, disrupt, scrape, or misuse the website

• upload malicious code or interfere with site operations

• use the website for unlawful purposes

We may suspend or block access for misuse.

13) Privacy

We handle personal information in accordance with our Privacy Policy (available on this website). Generally, we collect information necessary to process orders and provide customer support.

14) Governing law

These Terms are governed by the laws of Australia. Any disputes will be handled in the relevant Australian courts.
